Terms and Conditions of Lift Ticket use:

1. You acknowledge that you will observe the Alpine Responsibility Code (copies available on request) and that you will conduct yourself in a safe and controlled manner at all times.
2. You must read all signs and follow all directions given by us, our employees and agents.
3. You engage in any recreational activity at your own risk and you acknowledge that we are not liable for any breach of any express or implied warranty that services we provide will be provided with reasonable care and skill.
4. We make no warranties in relation to the services to be provided. Without limiting paragraph 3 above, all warranties, representations or conditions relating to the services we provide (whether express or implied and whether arising in contract at common law or under statute) are to the maximum extent permitted by law expressly excluded and you acknowledge that our liability under any statutory right or any condition or warranty implied by the Trade Practices Act, 1974 which cannot be excluded, is limited at our option to the resupply of the services or the payment of the cost of having the services supplied again.
5. You acknowledge that we are not liable to you for any loss, damage, injury or any incidental, indirect, special, consequential or economic loss or damage (including loss of opportunities, exemplary or punitive damages) whether to person or to property and whether arising from default, negligence, misconduct or otherwise by us, our employees or our agents and you indemnify us against all claims.

These conditions, together with the risk warning displayed below, form part of the conditions of entry and use of our facilities, equipment and services.

Any Lift Ticket:

1. Is valid for the dated period or the period from the date of first scan;
2. Remains our property at all times and must not be resold, transferred or altered in any way - and a breach of this condition will result in the confiscation of your ticket and may invoke police action;
3. Must be permanently attached to clothing on upper torso and be visible at all times;
   TICKET INVALID IF TICKET ATTACHMENT TIE HAS BEEN CUT OR NOT ATTACHED TO CLOTHING.
4. Will not be refunded or replaced if lost or stolen or if any facilities are not operating for any reason or if any portion of the ticket is unused;
5. May not entitle you to use some lifts as specified on the ticket or as directed by our authorised employees;
6. Does not entitle you to use of the resort facilities for any commercial purpose - except with our prior written consent;
7. Does not entitle you to provide or receive ski or snowboard instruction except where provided by us, our employees or our agents; and
8. 8. Unlimited use of Skitube between Perisher Valley and Blue Cow is valid for all valid lift tickets.

IF YOU BREACH ANY OF THE CONDITIONS OF THE TICKET WE MAY REQUIRE YOU TO FORFEIT THE TICKET AND YOU WILL LOSE ALL PRIVILEGES ASSOCIATED WITH THE TICKET.

Skiers/snowboarders must observe the Alpine Responsibility Code and ski/ride in a safe manner at all times. Failure to do so may result in a forfeiture of skiing/snowboarding privileges.

Terms and Conditions for Season Pass Use

Any season pass:

1. is valid for the ski/snowboard season as displayed on the season pass;
   
2. remains our property at all times and must not be resold, transferred or altered in any way – and a breach of this condition will result in the confiscation of the season pass and will invoke police action;
3. must be worn on the upper torso so as to be visible at all times;
   WILL NOT BE REFUNDED OR REPLACED IF LOST OR STOLEN OR IF ANY FACILITIES ARE NOT OPERATING FOR ANY REASON OR IF ANY PORTION OF THE SEASON PASS IS UNUSED;
4. may not entitle you to use some lifts as directed by our authorised employees;
5. entitles you to unlimited use of the Skitube between Perisher Valley and Blue Cow for the duration of the ski season as displayed on the season pass;
6. does not entitle you to provide or receive ski or snowboard instruction except where provided by us, our employees or our agents.

Terms and Conditions of use:

1. You acknowledge the risk warning set out in bold and capitals below and that the warning constitutes a risk warning pursuant to the Civil Liability Act, 2002.
2. You acknowledge that you will observe the Alpine Responsibility Code (copies provided when you purchases a season pass or available on request) and that you will conduct yourself in a safe and controlled manner at all times.

Additional Terms and Conditions for Super Pass:
A Super Pass is subject to the above terms and conditions and the terms and conditions below:

1. One day lift tickets issued to Super Pass holders are non-refundable and non-transferable.
2. Hotham and Falls Creek Super Pass holders are not entitled to any discounts or privileges made available to Perisher Super Pass holders at Perisher other than lift ticket benefits.
3. Perisher Super Pass holders are not entitled to any discounts or privileges made available to Hotham and Falls Creek Super Pass holders at Hotham and Falls Creek other than lift ticket benefits.
4. Super Pass holders must agree to and abide by the terms and conditions of use of each resort when using the applicable resort’s facilities.
5. To gain access to Perisher lifts, Hotham and Falls Creek Super Pass holders must present their Super Pass at a Perisher Ticket Office to be issued with a one day lift ticket on each day they wish to use the lifts.
6. To gain access to Hotham or Falls Creek lifts, Perisher Super Pass holders must present their Super Pass at a Hotham or Falls Creek Ticket Office to be issued with a one day lift ticket on each day they wish to use the lifts.
7. Hotham and Falls Creek Super Pass holders are eligible to receive one only one day lift ticket at Perisher per day.
8. Perisher Super Pass holders are eligible to receive one only one day lift ticket at Hotham or Falls Creek per day.
9. A Super Pass holder that has been issued with a one day lift ticket must have their Super Pass and issued one day lift ticket on their person at all times when using any lift, and must present their Super Pass and lift ticket for verification if requested to by an authorised officer of the resort in order to access any lift.
10. Any breach of the Super Pass Terms and Conditions of Use or Terms and Conditions of Perisher, Hotham or Falls Creek could result in confiscation of the Super Pass and lift ticket and may invoke police action.
11. Super Pass holders will be issued with an Adult, Over 65 or Student lift ticket as outlined above consistent with Adult, Over 65 or Student designation of their Super Pass.
12. Super Pass does not provide access to Falls Creek Night Skiing.

IF YOU BREACH ANY OF THE CONDITIONS OF THE SEASON PASS WE MAY REQUIRE YOU TO FORFEIT THE SEASON PASS AND YOU WILL LOSE ALL PRIVILEGES ASSOCIATED WITH THE SEASON PASS.
